RE: The tariff classification of woman’s vest from Vietnam

Dear Mr. McManus:

In your letter dated June 14, 2007, you requested a classification ruling on behalf of ITOCHU Prominent USA LLC. Your sample will be returned as requested.

Submitted sample, style #67130, is a woman’s vest constructed from 100% polyester woven fabric. The vest is fully lined and features oversized armholes, a quilted outer shell, a stand up collar, side seam pockets, an off center full front opening secured by four snaps, a hemmed bottom and decorative embroidery. The garment is lightly padded. The vest provides insufficient coverage for wear without another outer garment.

The applicable subheading for the style 67130 will be 6211.43.0076, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garment, women’s or girls’: of man-made fibers: vests: other. The duty rate will be 16 percent ad valorem.

Style 67130 falls within textile category 659. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
