RE: The tariff classification of insulated cooler bag from China

Dear Mr. Knight:

In your letter dated May 30, 2007, you requested a classification ruling. Your samples will be returned as requested.

The samples submitted are identified as collapsible cooler bags, styles CB5368-36 and CB6006D-6. Style CB5368-36 is constructed with an outer surface of man-made fiber textile material. The cooler is designed to contain ice and is principally used to maintain the temperature of food or beverages. The interior of the bag has a main insulated compartment with a waterproof vinyl lining and holds up to 36 cans of beverages. The exterior of the cooler bag has a large zippered pocket with a mesh pocket overlay. The top of the bag is secured by means of a zippered closure on three sides of the bag. The bag is carried by means of an adjustable webbed textile shoulder strap. It measures approximately 12” (W) X 12” (H) x 8” (D).

Style CB6006D-6 is a collapsible cooler bag constructed with an outer surface of man-made fiber textile material. The cooler is designed to contain ice and is principally used to maintain the temperature of food or beverages. The interior of the bag has a main insulated compartment with a waterproof vinyl lining and holds up to 6 cans of beverages. The exterior of the cooler bag has a mesh pocket. The top of the bag is secured by means of a zippered closure on three sides of the bag. The bag is carried by means of an adjustable webbed textile shoulder strap. It measures approximately 9” (W) x 7” (H) x 5” (D).

In your ruling request you suggested classification of the cooler bags under 4202.92.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for insulated food and beverage bags, other. However, the essential character of the bag is given by the man-made textile material as it is the majority of the total outer surface area. HTSUS 4202.92.1000 provides for insulated cooler bags constructed with an outer surface of materials other than textiles.

The applicable subheading for the styles CB5368-36 and CB6006D-6 will be 4202.92.0807, HTSUS, which provides for insulated food and beverage bags, with outer surface of textile materials, other, of man-made fibers. The duty rate will be 7% ad valorem.

HTSUS 4202.92.0807 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
