RE: The tariff classification of a women’s shirt from Cambodia

Dear Ms. Shu:

In your letter dated June 11, 2007 you requested a classification ruling.

Style 2342 is a woman’s polo shirt constructed of 100 percent polyester pique knit fabric. The garment has raglan sleeves and extends below the waist. It features a partial front opening with a right-over-left five button closure, a collar and a hemmed bottom. The garment has at least 10 or more stitches per linear centimeter measured in both directions.

We are returning your sample as you requested.

The applicable subheading for style 2342 will be 6106.20.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’s or girls’ blouses and shirts, knitted or crocheted: Of man-made fibers: Other: Women’s. The duty rate will be 32% ad valorem.

Style 2342 falls within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise, which is the product of World Trade Organization (WTO) member countries.
