RE: The tariff classification of “Cart Organizer” from China

Dear Ms. Reid:

In your letter dated May 31, 2007, you requested a classification ruling. Your sample will be returned as requested.

The sample submitted is identified as a multi-pocketed organizer cover that fits over a cart. A style number was not provided. In your letter you state that the item can be used for storing tools, home and gardening supplies, office supplies, etc. It is constructed with an outer surface of 100 percent polyester textile material. It has eight pockets of various sizes that secure with a hook and loop closures. The organizer has a pocket that contains an expandable plastic file used to store documents. There is also a zippered pocket that contains two mesh pockets, and two elastic bands to hold tools or similar type items.

The applicable subheading for the “Cart Organizer” will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other bags and containers, with outer surface of man-made textile material. The duty rate will be 17.6 percent ad valorem.

HTSUS 4202.92.9026 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
