RE: The tariff classification of a forklift forks from China

Dear Mr. Nagel:

In your letter dated June 12, 2007, you requested a tariff classification ruling. You submitted product specifications with your request.

The merchandise in question is identified by you as forks used for forklift trucks. These items are forks made of hot rolled bar steel with a cross section of 35mm X 100mm with blade lengths of 1000mm,1100mm,1200mm,1400mm and a standard 535mm back height. These forks have an upper and lower hook casting welded at a standard spacing to accommodate ITA (International Trucking Association) specifications. The upper hook includes a spring-loaded locating pin. The principal use of these items is to hang on the front of a fork-lift truck allowing the truck to lift and move goods. These items are commonly known as 'ITA Forks'.

The applicable subheading for the forks will be 8431.20.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for parts of the machinery of heading 8427. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
