RE: The tariff classification of men’s knit pants from Kenya.

Dear Ms. Shu:

In your letter dated June 4, 2007, you requested a tariff classification ruling. As requested, your sample will be returned.

Style 9089 “Force Bi-Colored Tricotex Pant with Inserts” is a pair of men’s pants constructed from 100% polyester, finely knit tricot fabric that is brushed on the inside surface. The pants feature a tunnel elastic waistband; side seam pockets; ankle zippers on the side of each leg; and a hemmed bottom. Style 9089 will be imported in men’s sizes S-3XL.

The applicable subheading for Style 9089 “Force Bi-Colored Tricotex Pant with Inserts” will be 6103.43.1520, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s and boys’ trousers, knitted or crocheted: of synthetic fibers: trousers: other: men’s. The rate of duty will be 28.2% ad valorem.

Style 9089 falls within textile category designation 647. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
