RE: The tariff classification of a woman’s Jacket from Hong Kong

Dear Ms. Fox:

In your letter dated June 6, 2007, you requested a classification ruling on behalf of Jones Apparel Group. Your sample will be returned as requested.

Submitted sample, style #1FHC35008, is a woman’s faux fur jacket constructed from 83% acrylic and 17% cotton woven fabric. The garment extends from the shoulder to the waist. The fully lined garment features a stand up collar, short sleeves, a full front opening secured by a hook and eye closure at the waist and a 100% wool rib knit waist band.

The applicable subheading for the style 1FHC35008 will be 6211.43.0078, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of man-made fibers: jackets and jacket-type garments excluded from heading 6202. The duty rate will be 16 percent ad valorem.

Style 1FHC35008 falls within textile category 635.
