RE: The tariff classification of Sodium 4-fluorobenzoate solution, Product code IWT-1200, CAS No. 499-90-1, from the United Kingdom

Dear Mr. Holmgren:

In your letter dated June 4, 2007 you requested a tariff classification ruling.

The subject product, Sodium 4-fluorobenzoate solution, CAS No. 499-90-1, is 10% Sodium 4-fluorobenzoate in an aqueous solution. For tariff classification purposes as per Chapter 29 Note 1(d), products dissolved in water are classified as separate chemically defined organic compounds in Chapter 29. Sodium 4-fluorobenzoate is a sodium salt of a halogenated derivative of an aromatic carboxylic acid indicated for use as a chemical interwell tracer. Based on the information provided, interwell tracers track fluid movement in reservoirs.

The applicable subheading for Sodium 4-fluorobenzoate solution will be 2916.39.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Aromatic monocarboxylic acids, their anhydrides, halides, peroxides, peroxyacids and their derivatives: Other: Other: Other: Products described in additional U.S. note 3 to section VI. The rate of duty will be 6.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
