RE: The tariff classification of Beanie-Style Hats from China.

Dear Mr. Ashear:

In your letter dated June 1, 2007, you requested a classification ruling. The samples will be returned to you.

Five samples of Men’s Beanie-Style Hats were submitted with your request. The hats are made of knit 100% acrylic fabric.

Style AW47AC108 is a solid colored hat that will be made in several colors.

Styles AW47AC111, AW47AC112, AW47AC113 and AW47AC114 will be made in several stripe combinations.

The applicable subheading for the Styles AW47AC108, AW47AC111, AW47AC112, AW47AC113 and AW47AC114 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric...Other: Of man-made fibers: knitted or crocheted or made up from knitted or crocheted fabric: not in part of braid, Other: Other: Other." The duty rate will be 20 cents per kilogram plus 7% ad valorem. The textile category designation is 659.
