RE: The tariff classification of a woman suit-type jacket from China

Dear Mr. Ramos:

In your letter dated May 24, 2007, you requested a classification ruling. Your sample will be returned as requested.

Submitted sample, style #PP370705, is a woman’s suit-type jacket constructed from 96% cotton and 4% spandex woven velvet fabric. The garment features a collar and lapels, long sleeves, shoulder pads, two patch pockets below the waist, a full front opening secured by one button and side vents.

The applicable subheading for the style #PP370705 will be 6204.32.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suit-type jackets and blazers: of cotton: other: other: women’s. The duty rate will be 9.4 percent ad valorem.

Style PP370705 falls within textile category 335.
