RE: The tariff classification of socks from China

Dear Mr. Ashear:

In your letter dated May 31, 2007, you requested a classification ruling on behalf of your customer, Wal-Mart Stores, Inc. The submitted sample will be returned.

Four samples were submitted for review. Styles 52L71064-1 and 52L71068-1 are anklet style socks constructed of 66% acrylic, 32% polyester and 2% spandex knit fabric. The ankle length socks feature a hemmed rib-knit elasticized top.

Style 52L71065-1, is an anklet style sock constructed of 69% acrylic, 29% polyester and 2% spandex knit fabric. The ankle length socks feature a hemmed rib-knit elasticized top.

Style 52L71069-1, is an anklet style sock constructed of 68% acrylic, 30% polyester and 2% spandex knit fabric. The ankle length socks feature a hemmed rib-knit elasticized top.

The applicable subheading for the aforementioned styles will be 6115.96.9020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other “Panty hose, tights, stockings, socks and other hosiery, other: of synthetic fibers: other, other.” The duty rate will be 14.6 percent ad valorem.

The socks fall within textile category 632. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
