RE: The tariff classification of a woman’s skirt from China or Hong Kong

Dear Mr. DeVitto:

In your letter dated May 10, 2007 you requested a classification ruling on behalf of your client Telluride Clothing Co.

Style M071827 is a woman’s balloon skirt constructed of 100 percent silk printed woven fabric. The skirt has an overlay constructed from 100 percent polyester mesh knit fabric. It features an elasticized waistband and a partial zipper opening with a hook and loop closure on the left side. The mesh overlay is folded under at the bottom of the skirt and sewn to the bottom of the woven fabric. The woven portion imparts the essential character of the skirt.

The applicable subheading for style M071827 will be 6204.59.4040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’sskirts: Containing 70 percent or more of silk. The duty rate will be 6.6% ad valorem.

Style M071827 falls within textile category 742.
