RE: The tariff classification of a hanging organizer and a pen stand

Dear Mr. Shukla:

In your letter dated May 31, 2007, you requested a tariff classification ruling.

The submitted samples include a 3-pocket hanging organizer, item #43, and a metal pen stand, #20. The wall hanging is a 3-pocket organizer for mail, papers, and such items. You state it is constructed of jute; if so, the fabrics are of jute fibers that have been twisted to form yarns that are woven into fabrics. A depiction of a scarecrow is woven into the fronts of the pockets. It measures approximately 30”H x 8½”W and features a plastic D-ring from which the item can be hung.

The applicable subheading for the organizer will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The duty rate will be 7% ad valorem.

The pen stand is a decorated cup formed of multiple layers of paperboard covered on the inner and outer surfaces with base metal; the bottom is a piece of base metal that has been tacked on.

The applicable subheading for the pen stand will be 8304.00.0000, HTSUS, which provides for desk-top filing or card-index cabinets, paper trays, paper rests, pen trays, office-stamp stands and similar office or desk equipment and parts thereof, of base metal, other than office furniture of heading 9403. The rate of duty will be 3.9 %.

Your inquiry does not provide enough information for us to give a classification ruling on the carry bag, the wall decoration, or the mirror. Your request for a classification ruling should include the following information:

Identify the material that the cane in the carry bag is made of (e.g. bamboo, rattan, etc.). Explain what processes the jute fibers in the wall decoration have undergone. Have they been crushed, carded, or combed in preparation for spinning? Is the mirror constructed of glass or metal?

When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
