RE: The tariff classification of bathroom accessories from China

Dear Ms. Bishop:

In your letter dated May 24, 2007, you requested a tariff classification ruling on behalf of Baltic Linen.

The merchandise under consideration consists of a hanging shower caddy, a toilet tissue holder and a tension pole caddy. Each comes in two styles, a hexagonal design and a mesh design. All are made of chrome plated steel or nickel plated steel.

The “Shower Caddy” fits over the shower head and has three shelves to hold soap, shampoo, etc. The “Toilet Tissue Holder” is designed to rest on a horizontal surface and hold up to three rolls of toilet paper. The “Shelf Corner Tension Pole Caddy” has a tension pole that fits ceiling to floor in the corner of a shower stall with four shelves that can hold shampoo, soap, razors, sponges, etc.

The applicable subheading for the toilet tissue holder and hanging shower caddy will be 7324.90.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sanitary ware and parts thereof, of iron or steel, other, including parts. The rate of duty will be free.

The applicable subheading for the tension pole caddy will be 9403.20.0015, HTSUS, which provides for other furniture and parts thereof, other metal furniture, household, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
