RE: The tariff classification of tote bag from China

Dear Ms. Stanczak:

In your letter dated May 23, 2007, you requested a classification ruling. Your sample will be returned as requested.

The sample submitted is identified as style B26. It is a tote bag constructed with an exterior surface of 100% polyester textile material. It is designed to provide protection, portability, storage, and organization to clothing, dance accessories, or other personal effects during travel. It features a textile-lined interior compartment with a top zippered opening, two elastic pockets, and webbed shoulder straps. The exterior of the bag has two side pockets and a zippered pocket on the front. It measures approximately 13.5” (W) x 11” (H) x 3.5” (D).

The applicable subheading for the tote bag will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with the outer surface of textile materials, other, of man-made fibers, other The duty rate will be 17.6%.

HTSUS 4202.92.3031 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
