RE: The tariff classification of a video game vest from China.

Dear Mr. Ombrellaro:

In your electronic ruling request dated May 22, 2007, you requested a tariff classification ruling.

The merchandise consists of a video game accessory in the form of a wearable vest. The device contains eight small air bladders with control valves and a small printed circuit board that controls the electronics. The vest system includes an air pump that drives air into the vest. The vest is designed to enhance the various experiences of video game action by imparting a variety of forces to the player, thus enhancing the sense of awareness of actions and a 3-dimensional appreciation of the virtual environment.

The applicable subheading for the video game vest peripheral will be 9504.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Articles or arcade, table or parlor gamesparts and accessories thereof.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
