RE: The tariff classification of a woman’s blouse from China

Dear Ms. Sampson:

In your letter dated May 17, 2007, you requested a classification ruling. Your sample will be returned as requested.

Submitted sample, style #43609, is a woman’s blouse constructed from 100% polyester woven fabric. The garment features a collar, long sleeves with elasticized cuffs, shoulder pads, a zippered full front opening and elasticized bottom.

In your letter you indicated this sample has side seam pockets, the submitted sample does not have side seam pockets but the sample does have shoulder pads which were omitted in your description.

The applicable subheading for the style 43609 will be 6211.43.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garment, women’s or girls’: of man-made fibers: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments, excluded from heading 6206. The duty rate will be 16 percent ad valorem.

Style 43609 falls within textile category 641. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
