RE: The tariff classification of a woman’s cardigan from China.

Dear Mr. Pascarella:

In your letter dated May 14, 2007, on behalf of Presidio International, Inc., you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, style D5M220HO, is a woman’s cardigan that is constructed from 76% cotton, 24% polyester knit fabric. The outer surface of the fabric measures more than 9 stitches per 2 centimeters in the direction that the stitches were formed. The garment features a hood with a 80% acrylic, 20% polyester knit pile lining, long sleeves with contrasting cuffs, a full front opening, belt loops at the waist, a self-fabric tie belt at the waist, 2 front slant pockets below the waist, and a loose-fitting bottom. The front panels curve at the bottom.

The applicable subheading for the cardigan will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweatersand similar articles, knitted: of cotton: otherother: women’s. The duty rate will be 16.5% ad valorem.

The cardigan falls within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
