RE: The tariff classification of a woman’s top from Brazil.

Dear Ms. Stanczak:

In your letter dated May 10, 2007 you requested a classification ruling.

Style Wrap is a woman’s top constructed from 85 percent acrylic 15 percent polyamide knit fabric. The abbreviated garment has a full front opening and extends from the neck to just below the bust with a self fabric tie closure which wraps around the waist and ties in the back. It has a rib knit bottom and ¾ length sleeves with rib knit cuffs. The garment provides sufficient coverage in the bust area.

The applicable subheading for style Wrap will be 6114.30.1020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other garments, knitted or crocheted: Of man-made fibers: Tops: Women’s. The duty rate will be 28.2% ad valorem.

Style Wrap falls within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise, which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
