RE: The tariff classification of a woman’s coat from China

Dear Mr. Hoffacker:

In your letter dated May 14, 2007, on behalf of Sugartown Worldwide, Inc., you requested a classification ruling.

The sample you submitted, style number 66224 “Ladies Daria Coat,” is a woman’s coat with a decoratively printed shell composed of a woven 100% cotton fabric. The coat is lined with a woven man-made fiber fabric.

The coat is fitted at the waist, extends to the knee area in length, and has a mandarin-style collar, a decorative non-functional button and loop closure at the front portion of the neck area and a full front opening secured by four right-over-left, snap closures. The coat has long sleeves with banded cuffs, shoulder pads, two front in-seam pockets below the waist and a banded bottom hem.

The sample is being returned to you as you have requested.

The applicable subheading for the coat will be 6202.12.2050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other women’s overcoats, carcoats, capes, cloaks and similar coats: of cotton: other: other. The duty rate will be 8.9 percent ad valorem.

The coat falls within textile category 335. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
