RE: The tariff classification of a flimsy costume from China.

Dear Ms. Beck:

In your letter dated May 7, 2007, you requested a tariff classification ruling.

You submitted the following costume, which meets the flimsy, non-durable requirements for classification within Chapter 95 and is being returned upon your request.

Item 62052, Cheetah Girls Fabulously Fun Dress Up Set, is a textile costume set that consists of a pink top with the screen-printed words, “the Cheetah Girls”, a pair of cheetah-print pants, plastic shoes, a belt, a headband, plastics bracelets and earrings, with the dress imparting the essential character. Although the dress has one well-made embellishment (sewn sequins on top), it has flimsy and loose visible overlock stitching of the neck, flimsy and loose visible overlock stitching of the interior seams, a flimsy hook and loop tab closure and flimsy and loose visible overlock stitching at the arms, bottom and closure edges.

The applicable subheading for item 62052, Cheetah Girls Fabulously Fun Dress Up Set, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
