RE: The tariff classification of a girls’ jacket from China.

Dear Mr. Chen:

In your letter dated May 4, 2007, you requested a tariff classification ruling.

The submitted sample, style 36412 is a girl’s jacket constructed of knit 95% cotton, 5% spandex fabric. The jacket features a hood with a drawstring, a full frontal opening with zipper closure, long sleeves with rib-knit cuffs, kangaroo pockets and a rib-knit bottom that reaches the waist.

The applicable subheading for style 36412 will be 6102.20.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ overcoats, carcoats, capes, cloaks, anoraks, wind-breakers, and similar articles, knitted or crocheted, other than those of heading 6104: of cotton, girls’. The rate of duty will be 15.9 percent ad valorem.

Style 36412 falls within textile category 335. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
