RE: The tariff classification of a USB flash card storage device from Singapore

Dear Ms. Hanson:

In your letter dated May 7, 2007 you requested a tariff classification ruling on behalf of your client, TEAC Corporation.

The merchandise under consideration is an internal USB flash card storage device that reads and writes data (model CAB-200). It is configured with Bluetooth technology and an interface for flash memory cards. The Bluetooth technology has a transceiver that enables wireless connectivity. The device measures 4 inches x 1 inch x 5.68 inches, and consists of a main printed circuit board, a sub-printed circuit board assembly, a flexible printed circuit, the Bluetooth module, a front bezel, a top cover, and a chassis. It has two monochrome status light emitting diodes (LED) and no other display. The device is intended to be used internally in a computer, and utilizes a standard 3.5 inch drive bay, the same as a floppy device.

The storage device contains four flash card slots, and contacts that connect to the flash cards when they are inserted into the slot. It connects to an automatic data processing (ADP) machine with Bluetooth technology rather than a cable.

The storage device transfers data between media cards for an electronic device (such as a digital camera or handheld device) and a computer without having to connect the device itself to the computer. It accepts various memory cards, smart cards, flash cards, and memory sticks. It contains four data storage modes: FAT12, FAT16, FAT32, and NTFS.

The applicable subheading for the USB flash card storage device with Bluetooth technology (model CAB-200) will be 8471.70.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides "Automatic data processing machines and units thereofStorage units: Other storage units: Not assembled in cabinets for placing on a table, desk, wall, floor or similar place." The rate of duty will be free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Denise Faingar at (646) 733-3010.
