RE: The tariff classification of a woman’s sweater from China.

Dear Ms. Giarraputo:

In your letter dated April 30, 2007, on behalf of DZ Trading, 110 E. 9th St., Suite C701, Los Angeles, CA 90079, you requested a classification ruling. Your sample is being returned.

The submitted sample, style SCWWP271, is a woman’s sweater that is constructed from 30% modal, 25% cotton, 20% nylon, 25% wool, cable knit fabric. The outer surface of the fabric measures 9 or fewer stitches per 2 centimeters in the direction that the stitches were formed. The garment features a notched modified shawl collar, long sleeves with ribbed cuffs, a full front opening with 4 button closures, 2 front patch pockets in the waist area, and a ribbed bottom.

The applicable subheading for the sweater will be 6110.30.1520, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, knitted: of man made fibers: other: containing 23 percent or more by weight of wool or fine animal hair: sweaters: women’s. The duty rate will be 17% ad valorem.

The sweater falls within textile category 446. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
