RE: The tariff classification of a costume garment from China.

Dear Mr. Fragomeli:

In your letter dated April 20, 2007, you requested a classification ruling. The sample will be returned.

The submitted sample, Item Number 6531315-LJTA (S) Violet Plaid Skirt, is a woman’s skirt constructed of woven 100% polyester fabric. The short skirt features a large sewn-in belt, well-made waist and seams. The skirt will also be imported as Item Numbers 6531316-LJTA (M) and 6531317-LJTA (L). The skirts are part of a mix and match Item Number 6531294-LJTA Assortment for a biker costume.

The applicable subheading for the Item Numbers 6531315-LJTA (S), 6531316-LJTA (M) and 6531317-LJTA (L) Violet Plaid Skirts will be 6204.53.3010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Women’s or girls’ suitsdresses, skirtsand shorts (other than swimwear): Skirts and divided skirts: Of synthetic fibers: Other: Other: Women’s.” The duty rate will be 16% ad valorem.

Item Numbers 6531315-LJTA (S), 6531316-LJTA (M) and 6531317-LJTA (L) fall within textile category 642. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
