RE: The tariff classification of a costume garment from China.

Dear Mr. Fragomeli:

In your letter dated April 20, 2007, you requested a classification ruling. The sample will be returned.

The submitted sample, Item Number 6531179-LJTA Pink Rodeo Chaps, are woman’s chaps constructed of knit 100% polyester fabric. The well-made chaps resemble the front portion of pants with a finished waist featuring a buckle closure at the front and lace-up closure at the back, reinforced seams, piping and an outer fringe. The chaps also come in Item Numbers 6531177-LJTA Black and 6531178-LJTA Grey and are part of a mix and match Item Number 6531176-LJTA Assortment for a cowgirl costume.

The applicable subheading for the Item Numbers 6531179-LJTA, 6531177-LJTA and 6531178-LJTA Chaps will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other garments, knitted or crocheted: Of man-made fibers: Other, Other: Women’s or girls’." The rate of duty will be 14.9% ad valorem.

Item Numbers 6531179-LJTA, 6531177-LJTA and 6531178-LJTA fall within textile category 659. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
