RE: The tariff classification of a girl’s garment from China.

Dear Ms. Caldwell:

In your letter dated March 13, 2007 you requested a classification ruling. The sample is being retained for reference purposes.

Style 29H816 is a knit upper body garment. The article is described as a sweater with a mock tank top. The appearance creates the visual impression of a long sleeve cropped sweater existing over a rib knit tank top. The upper body including the sleeves and chest are made of 55% ramie, 45% cotton fabric containing 9 or fewer stitches per 2 centimeters measured in the direction the fabric is formed. The lower body is made of finely rib knit cotton fabric. The pullover style garment has a round neckline and a hemmed bottom.

The garment is a composite good consisting of distinct ramie, cotton fabric and cotton fabric components. The essential character of the garment is imparted by the 55% ramie, 45% cotton fabric in accordance with General Rule of Interpretation (GRI) 3(b) of the Harmonized Tariff Schedule of the United States.

The applicable subheading for Style 29H816 will be 6110.90.9042, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of other textile materials: other: other: other: women’s or girls’. The duty rate will be 6%.

Style 29H816 falls within textile category 845. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
