RE: The tariff classification of a costume garment from China.

Dear Mr. Fragomeli:

In your letter dated April 20, 2007, you requested a classification ruling. The sample will be returned.

The submitted sample, Item Number 6531295-LJTA Cheetah Wrap Skirt, is a woman’s skirt constructed of knit 100% polyester cheetah print fabric. The short wrap skirt has an overlap and is secured at the waist by an approximately 2¼ inch wide fabric tie. The well-made garment features a finished fabric tie with an over-size metal grommet, a finished waist and reinforced seams. The garment is part of a mix and match Item Number 6531294-LJTA Assortment for a cowgirl costume.

The applicable subheading for the Item Number 6531295-LJTA Cheetah Wrap Skirt will be 6104.53.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Women’s or girls’dresses, skirts, divided skirtsknitted or crocheted: Skirts and divided skirts: Of synthetic fibers: Other, Women’s.” The duty rate will be 16 percent ad valorem.

Item Number 6531295-LJTA falls within textile category 642. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
