RE: The tariff classification of gloves from China

Dear Ms. Ramsey:

In your letter dated April 19, 2007, you requested a classification ruling. The samples provided will be returned.

Style 59490 “Convertible Micro-Fleece Gloves,” is a lined and insulated half-fingered glove constructed of 100% knitted polyester fleece fabric. The glove features a sewn-on mitten style cover that can be placed over the fingers or secured with hook and loop fasteners when not in use. Additional features include a slit in the palmside thumb, a ribbed knit cuff, fourchettes, an elasticized wrist, and a hook and clasp.

The applicable subheading for style 59490 will be 6116.93.9400, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Gloves, mittens and mitts, knitted or crocheted: other: of synthetic fibers: other: other: with fourchettes. The duty rate will be 18.6 percent ad valorem.

Style 59490 falls within textile category 631. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
