RE: The tariff classification of a placemats and napkin rings from China

Dear Mr. Morse:

In your letter dated April 19, 2007 you requested a classification ruling on behalf of Kim Seybert Inc.

The submitted samples, identified as styles 7253 and 4738, are placemats and napkin rings. The placemat in style 7253 is made from strips of woven 100 percent polyester fabric. The strips are folded and sewn together to form the 13.5 x 19 inch placemat. The napkin ring is made from the same strips and fiber content as the placemat. The fabric strips have been braided to form the napkin ring. It measures approximately 1.5 inches in diameter.

The placemat and napkin ring in style 4738 is made from ¼ inch wide braid composed predominately from paper yarns. The circular placemat measures approximately 15 inches in diameter. The face of the placemat features plastic sequins. The napkin ring measures approximately 1-3/4 inches in diameter. In a phone conversation you indicated that the placemats and napkin rings would be imported separately.

The applicable subheading for the placemat (style 7253) will be 6302.53.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bed linen, table linen, toilet linen and kitchen linen: other table linen: of man-made fibers other. The duty rate will be 11.3 percent ad valorem.

The applicable subheading for the placemat (style 4738) will be 6302.59.3020, HTSUS, which provides for bed linen, table linen, toilet linen and kitchen linen: other table linen: of other textile materials: other other. The duty rate will be 8.8 percent ad valorem.

The applicable subheading for the napkin ring (style 7253) will be 6304.93.0000, HTSUS, which provides for other furnishing articles, excluding those of heading 9404: other: not knitted or crocheted, of synthetic fibers. The duty rate will be 9.3 percent ad valorem.

The applicable subheading for the napkin ring (style 4738) will be 6304.99.6040, HTSUS, which provides for other furnishing articles, excluding those of heading 9404: other: other: otherother: other. The rate of duty will be 3.2 percent ad valorem

The placemat and napkin ring in style 7253 fall within textile category 666. The placemat and napkin ring in style 4738 fall within textile category designation 899. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
