RE: The tariff classification of a Ceramic Pumpkin Planter with wire pick from China.

Dear Ms. Powell:

In your letter dated April 17, 2007 you requested a tariff classification ruling.

The submitted sample, designated in your letter as article numbers 0720 and 0720A, is a ceramic planter in the shape of a pumpkin, with a removable ceramic lid. You indicated in your letter that the planter will be imported with a wire pick.

You stated that this product will be sold to individual florists for use in floral arrangements. You specified in your letter that a florist will fill the planter with flowers in floral foam and that the lid will be attached to the pick and stuck in the floral foam. The wire pick, which is removable, is designed to hold up the lid.

The applicable subheading for the Ceramic Pumpkin Planter with wire pick will be 6913.90.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Statuettes and other ornamental ceramic articles: Other: Other: Other”. The rate of duty will be 6% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
