RE: The tariff classification of a woman’s jacket from Hong Kong

Dear Mr. Hyland:

In your letter dated April 12, 2007, you requested a classification ruling. Your sample will be returned as requested.

Submitted sample, style #BP126739, is a woman’s jacket constructed from 99% cotton and 1% spandex woven fabric. The garment features a collar, a detachable hood, long sleeves with buttoned cuffs, two chest pockets with snap flaps, two pockets below the waist with snap flaps, a full front opening secured by five buttons and a banded bottom.

In your letter you suggest a classification of subheading 6202.92.2061, HTSUS. Style BP126739 is properly classified under subheading 6211.42.0075, HTSUS. The garment is a shirt-jacket, a hybrid garment, which lacks sufficient characteristics to be considered a jacket.

The applicable subheading for the style BP126739 will be 6211.42.0075, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: jacket and jacket-type garments excluded from heading 6202. The duty rate will be 8.1 percent ad valorem.

Style BP126739 falls within textile category 335.
