RE: The tariff classification of a costume garment from China.

Dear Mr. Fragomeli:

In your letter dated April 13, 2007, you requested a classification ruling. The sample will be returned.

The submitted sample is an Item Number 6861022-LJUG (M) and 6861019-LJUG (L) upper body garment, which you refer to as a cotton twill punk vest. The upper body garment is constructed of woven cotton twill fabric. The garment reaches to the waist and has normal size armholes. The well-made garment features an over-size zipper, over-size metal grommets, chains, numerous styling features, and finished neck and seams. The garment is part of a mix and match assortment for a punk teen costume.

The applicable subheading for the Item Number 6861022-LJUG (M) and 6861019-LJUG (L) upper body garment will be 6206.30.3041, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “ Women’s or girls’ blouses, shirts and shirt-blouses: Of cotton: Other: Other, Other: Other: Women’s.” The duty rate will be 15.4 percent ad valorem.

Item Number 6861022-LJUG (M) and 6861019-LJUG (L) fall within textile category 341. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
