RE: The tariff classification of the Glitter Glue Galaxy from China

Dear Mr. Helfand:

In your letter dated April 11, 2007, on behalf of The Horizon Group, you requested a tariff classification ruling.

The merchandise is identified in your letter as the Glitter Glue Galaxy, item number 10690. The item consists of a glue squeezer/dispenser, paper and twenty four tubes of glitter glue. The glue dispenser has a self-contained electric motor. The operating instructions indicate that the tube of glue is opened by removing the cap, and then the tube is inserted into the motorized dispenser. Squeezing the lever on the dispenser forces the glue through the nozzle and onto a surface. The user can decorate stationery, posters, books, cards, letters and similar surfaces. You indicate in your letter, that The Horizon Group also plans to import a motorized squeezer/ dispenser with forty tubes of glitter glue.

Your sample is being returned as requested.

The applicable subheading for the Glitter Glue Galaxy and the motorized squeezer/dispenser with forty tubes of glitter glue will be 8509.80.5095, Harmonized Tariff Schedule of the United States (HTSUS), which provides for electromechanical domestic appliances, with self-contained electric motor, other than vacuum cleaners of heading 8508, other appliances, other, other. The rate of duty will be 4.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
