RE: The tariff classification of a men’s sweater from China.

Dear Mr. Spoto:

In your letter dated April 11, 2007, you requested a tariff classification ruling on behalf of Kemistre 8 LLC. As requested, your sample will be returned.

Style P39S04 is a men’s sweater constructed from 40% cotton, 30% nylon, 30% merino wool, jersey knit fabric that measures 4 stitches per two centimeters counted in the horizontal direction. Style P39S04 features a cross-over V-neckline; a stand-up collar; leather on the outer surface of the collar and V-neck; two metal buckles at the neck; long sleeves with rib knit cuffs; a leather pouch pocket below the waist; and a rib knit bottom.

The applicable subheading for Style P39S04 will be 6110.20.2010, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: sweaters: men's. The rate of duty will be 16.5% ad valorem.

Style P39S04 falls within textile category 345. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
