RE: The tariff classification of a woman’s sweater from China.

Dear Mendoza:

In your letter dated April 3, 2007 you requested a classification ruling. As requested, your sample is being returned to you.

The submitted sample, style F35U4, is a woman’s sweater that is constructed from 100% cashmere knit fabric. The outer surface of the garment measures nine or fewer stitches per two centimeters in the horizontal direction. The garment features a v-neck full front opening, three shell button closures, a self-fabric tie at the waist, long sleeves with rib knit cuffs, and a rib knit bottom. The sweater also has decorative saddle stitching at the shoulder, back yoke, and down the front panels beside the placket.

The applicable subheading for the sweater will be 6110.12.1020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted (con): of wool or fine animal hair (con): of Kashmir (cashmere) goats: wholly of cashmere: sweaters: women’s. The duty rate will be 4% ad valorem.

The sweater falls within textile category 446. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
