RE: The tariff classification of a woman’s dress from China.

Dear Ms. Mendoza:

In your letter dated April 3, 2007 you requested a classification ruling. As requested, your sample is being returned to you.

The submitted sample, style F34U4, is a woman’s dress that is constructed from 100% cashmere knit fabric. The dress extends from the shoulders to the knees. The garment features a cowl neck, an optional Chinese knot closure at the neck, long sleeves with rib knit cuffs, a rib knit bottom finish, a left side slit at the garment bottom, and two belt loops with a self-fabric tie belt.

The applicable subheading for the dress will be 6104.41.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear), knitted or crocheted (con): dresses: of wool or fine animal hair: women’s. The duty rate will be 13.6% ad valorem.

The dress falls within textile category 436. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
