RE: The tariff classification of a woman’s pullover from China.

Dear Ms. Mendoza:

In your letter dated April 3, 2007 you requested a classification ruling. As requested, your sample is being returned to you.

The submitted sample, style F41U4, is a woman’s pullover that is constructed from 100% cashmere knit fabric. The outer surface of the fabric measures more than nine stitches per two centimeters in the direction that the stitches were formed. The garment features a cowl neckline, a double layered front panel, long sleeves with 2x2 rib knit cuffs, and a 2x2 rib knit garment bottom.

The applicable subheading for the pullover will be 6110.12.1060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted (con): of wool or fine animal hair (con): of Kashmir (cashmere) goats: wholly of cashmere: sweaters: other: women’s. The duty rate will be 4% ad valorem.

The pullover falls within textile category 446. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
