RE: The tariff classification of a screenhouse from China

Dear Mr. Anuschat:

In your letter dated April 4, 2007, you requested a tariff classification ruling on behalf of your client, Fred Meyer, Inc./The Kroger Co., of Portland, Oregon.

You submitted a photograph of a screenhouse. It is described as “Importer PO 02912648 and 500-32821, Cabin Style Garden House with Mosquito Netting.” It is 8’ 2” square; the height is not given. It has four corner posts, a roof said to be of 100% polyester, and guide ropes at each corner, which we assume are attached to stakes. The sides are of a mesh or net fabric and can be pulled and tied at the corner posts

The applicable subheading for the screen house as described above will be 6306.22.9010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Tents: Of synthetic fibers: Other, Screen house. The general rate of duty will be 8.8% ad valorem.

You state that the vendor advises that the correct classification is in subheading 6306.99.0000, HTSUS, which provides for camping goods: Other: Of other textile materials. Please note that subheading 6306.22.9010 more specifically describes the item.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
