RE: The tariff classification of a girls’ pullover from China.

Dear Mr. Johnson:

In your letter dated March 28, 2007, you requested a tariff classification ruling. As requested, the sample will be returned to you.

Your submitted sample, style 504562 is a girl’s pullover constructed from 100% cotton knit fabric. The outer surface of the garment measures between nine and eighteen stitches per two centimeters in the direction in which the fabric was formed. The garment features a hood, V-neckline, long sleeves with rib-knit cuffs and finished bottom with side vent. The tubular jersey fabric at the inside nape at the neck is not knit to shape. Thus, the pullover does not meet the requirements of Statistical Note 6, Chapter 61, Harmonized Tariff Schedule of the United States (HTSUS).

The applicable subheading for style 504562 will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, waistcoats (vests) and similar articles, knitted or crocheted: of cotton, other, other: other: women’s or girls’: other. The rate of duty will be 16.5 percent ad valorem.

Style 504562 falls within textile category 339.
