RE: The tariff classification of a woman’s cardigan from Taiwan.

Dear Ms. Chioccola:

In your letter dated March 28, 2007 you requested a classification ruling. As requested, your sample is being returned to you.

The submitted sample, style 4222, is a woman’s cardigan that is constructed from 80% cotton and 20% polyester knit fabric that is brushed on the underside. The jacket features a drawstring hood, long sleeves with rib knit cuffs, a full front zippered opening, two patch pockets at the waist, and a loose fitting rib knit bottom.

You suggest that the garment be classified in heading 6102, HTSUS. However it is precluded from heading 6102 because of the loose-fitting bottom.

The applicable subheading for the cardigan will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweatersand similar articles, knitted: of cotton: otherother: women’s. The duty rate will be 16.5% ad valorem.

The cardigan falls within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
