RE: The tariff classification of a woman’s jacket from China.

Dear Ms. Shira:

In your letter dated March 26, 2007, on behalf of Polo Ralph Lauren Corp., 9 Polito Avenue, Lyndhurst, NJ, you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, style K0740X11W, which you call a “motorcycle jacket”, is a woman’s jacket that is normally worn over other garments for warmth and protection from the elements. The garment is constructed from 100% cotton terry knit fabric and features the following: a mock collar with 2 snap closures, long sleeves with zippered cuffs, a full front double-breast type opening with an off centered zipper closure and 3 snap closures at the top of the opening, 2 front inset vertical zippered pockets above the waist, 2 front inset horizontal zippered pockets at the waist, and 2 adjustable buckled belts with belt loops on the bottom rear.

The applicable subheading for the jacket will be 6102.20.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s overcoats, carcoats.and similar articles, knitted, other than those of heading 6104: of cotton: women’s. The duty rate will be 15.9% ad valorem.

The jacket falls within textile category 335. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
