RE: The tariff classification of a Pleo™ toy from China

Dear Mr. Mento:

In your letter dated March 26, 2007, you requested a tariff classification ruling, on behalf of Ugobe, Inc., your client.

You are requesting the tariff classification on an item that is identified as a Pleo™ toy product. The Pleo™ is a robotic toy dinosaur that is extremely high-tech. It is a sophisticated toy that is designed for children over eight years of age and for adults. It is capable of the following activities: making natural sounds, performing tricks, conveying emotions, and Pleo™ to Pleo™ communication. The toy behaves and interacts in a lifelike and natural manner. It will be considered a toy, classifiable in Chapter 95, for the purposes of the tariff.

The applicable subheading for the Pleo™ toy will be 9503.00.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for tricycles, scootersand similar wheeled toys; dolls’ carriages; dolls, other toys; reduced-scale (“scale”) modelsparts and accessories thereofother. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
