RE: The tariff classification of men’s knit jackets from China.

Dear Mr. Katsaros:

In your letter dated March 23, 2007, you requested a tariff classification ruling on behalf of Michael Gerald Ltd. As requested, your sample will be returned.

Style KYP7-670 is a men’s jacket constructed from 68% polyester, 32% cotton, doubleknit fabric that measures 19 stitches per 2 centimeters counted in the horizontal direction. Style KYP7-670 features a self-fabric stand-up collar; a full front opening with a zippered closure; long sleeves with close fitting self-fabric cuffs; side entry pockets below the waist; and a close fitting banded bottom. You state that this garment will also be imported in the same doubleknit fabric in a 53% cotton, 47% polyester blend as Style KYP7-970.

The applicable subheading for Style KYP7-670 will be 6101.30.2010, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: men’s or boys’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers, and similar articles, knitted or crocheted: other than those of heading 6103: of man-made fibers: other: men’s. The rate of duty will be 28.2% ad valorem.

The applicable subheading for Style KYP7-970 will be 6101.20.0010, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: men’s or boys’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers, and similar articles, knitted or crocheted: other than those of heading 6103: of cotton: men’s. The rate of duty is 15.9% ad valorem.

Style KYP7-670 falls within textile category designation 634. Style KYP7-970 falls within textile category designation 334.
