RE: The tariff classification of polyester/rayon upholstery fabric from China.

Dear Mr. Ponthieux:

In your letter dated March 13, 2007, you requested a tariff classification ruling.

The submitted sample is identified as pattern “JD54”. It is composed of 34% filament polyester and 66% rayon staple fibers. The fabric is jacquard woven with yarns of different colors. It contains 64 single yarns per centimeter in the warp and 35 single yarns per centimeter in the filling. This merchandise weighs 326 g/m2 and will be imported in 57-inch widths. Your correspondence indicates that this product will be used as an upholstery fabric.

The applicable subheading for this fabric will be 5516.23.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for woven fabrics of artificial staple fibers, containing less than 85 percent by weight of artificial staple fibers, mixed mainly or solely with man-made filaments, of yarns of different colors, other. The rate of duty will be 8.5 percent.

This fabric falls within textile category 629.
