RE: The tariff classification of child’s novelty bag from China

Dear Ms. Borges:

In your letter dated March 8, 2007, you requested a tariff classification ruling. The sample will be returned as requested.

The sample is identified as “My Little Pony Ponyville Carry Case #1.” The carry bag is constructed of 100% polyvinyl chloride (PVC) plastic sheeting. It features a textile-lined interior compartment with two wall pockets that secure with hook and loop fasteners. The word “Ponyville” is embroidered on the front exterior of the carry bag. The bag has a shoulder strap and a three-sided zipper opening. The bag is designed to provide storage, protection, organization and portability to a child’s personal effects during travel.

The applicable subheading for the bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sport, and similar bags, with outer surface of a sheeting of plastics. The rate of duty will be 20 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
