RE: The tariff classification of portable lamps from China.

Dear Ms. Sherrill:

In your letter dated March 22, 2007, you requested a tariff classification ruling.

The merchandise under consideration is the Coleman Battery Powered Table Lamp and the Coleman Battery Powered Deluxe Table Lamp. Samples of the lamps were submitted with your ruling request and will be returned to you. Both lamps are designed as lanterns for camping and other outdoor activities. They are powered by four D-cell batteries and feature push-button switches, removable shatter resistant frosted shades and rust resistant hanger loop handles at the top of each lamp.

The Coleman Battery Powered Table Lamp is constructed primarily of plastic and measures approximately 11 inches high by 6 inches wide at its widest point. This lamp features a krypton bulb for light. The Coleman Battery Powered Deluxe Table Lamp is also constructed primarily of plastic and measures approximately 12 inches high by 8 inches wide at its widest point. This lamp utilizes a xenon bulb for light and incorporates a five function digital clock within its base. The clock features a liquid crystal display (LCD) measuring approximately 1½ inch wide by ½ inch high. The five functions are controlled by three push-buttons and include day, month, second, minute and alarm.

The applicable subheading for the Coleman Battery Powered Table Lamp and the Coleman Battery Powered Deluxe Table Lamp will be 8513.10.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Portable electric lamps designed to function by their own source of energy (for example, dry batteries, storage batteries, magnetos)Lamps: Other.” The general rate of duty will be 3.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
