RE: The tariff classification of a men’s knit vest from China.

Dear Ms. Davide:

In your letter dated March 23, 2007, you requested a tariff classification ruling on behalf of Diesel USA, Inc. As requested, your sample will be returned.

Model 00C0R9 is a men’s vest constructed from 100% cotton, waffle knit fabric that measures 30 stitches per two centimeters counted in the horizontal direction. The vest is lined with jersey knit fabric and features a double collar of rib knit and jersey knit fabric, oversized armholes, a full front opening with a zippered closure, a vertical zippered pocket on the inside left chest, two pouch pockets below the waist, and a rib knit bottom. There is a woven fabric label sewn to the left pouch pocket.

The applicable subheading for Model 00C0R9 will be 6110.20.2030, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: vests, other than sweater vests: men’s or boys’. The rate of duty is 16.5% ad valorem.

Model 00C0R9 falls within textile category designation 359. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
