RE: The tariff classification of a woman’s suit-type jacket from Indonesia

Dear Ms. Dairo:

In your letter dated March 20, 2007, you requested a classification ruling. Your sample will be returned as requested.

Submitted sample, style #6483, is a woman’s suit-type jacket constructed from 45% polyester, 30% nylon, 20% wool and 5% spandex woven fabric. The garment is fully lined and is composed of more than four panels. The garment features a collar, full front opening secured by four self covered buttons, long sleeves, shoulder pads and two slit pockets at the waist.

The applicable subheading for the style 6483 will be 6204.33.5010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suit-types jackets and blazers: of synthetic fibers: other: women’s. The duty rate will be 27.3 percent ad valorem.

Style 6483 falls within textile category 635. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
