RE: The tariff classification of woman’s sleeveless pullover from Hong Kong.

Dear Ms. Lemler:

In your letter dated March 20, 2007 you requested a classification ruling on behalf of Target Stores. As requested, your samples are being returned to you.

The submitted sample, style 209392, is a woman’s sleeveless pullover that is constructed from a cut and sewn 100% cotton knit fabric. The outer surface of the garment measures more than 9 stitches per 2 centimeters in the direction that the stitches were formed. The garment features a v-shaped neckline with five simulated button closures at the gathered bust area, and a hemmed bottom. You asserted classification as a garment similar to a tank top under 6109, HTSUS. As the garment lacks shoulder straps reaching over the shoulders, the proper classification would be as a sleeveless pullover under 6110.20.2079, HTSUS.

The applicable subheading for the pullover will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: women’s or girls’: other. The duty rate will be 16.5%.

The pullover falls within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
